Mediation Services – Paxton-Penman Et Al

 

Unfortunately, we all find ourselves at some time of our lives in a conflict with another.  It may be around property, a neighbourly or boundary dispute.  It may be in the workplace with your employer, employee or fellow shareholder.  It may be to do with separation and dividing up property or working through a parenting agreement.  Perhaps the dispute relates to an estate and the division of property, or a trust issue and decisions made by trustees. Regardless of the basis of the dispute, Stephanie Paxton-Penman, an associate member of AMINZ, can assist you to try and reach resolve the conflict.

 

Litigation can often be used as a sledgehammer to crack a nut. There is a whole range of disputes where litigation is not beneficial to the parties involved.  It could be that financially the costs of litigation are prohibitive.  It may be that the extensive delays are going to destroy the relationship, not improve them.  It may be that the type of dispute is one where there is much mana in having control over the final outcome.  Litigation is expensive and is not designed as anything other than someone who is not privy to the disagreement imposing their views and decisions on others and those views and decisions becoming precedents.

 

Mediation is the opposite. It is cost effective, quick and the participants are encouraged and supported to explore settlement options. It doesn’t matter what other decisions have been made before – it is about the participants resolving their conflict, on their terms, to restore their mana and to walk out empowered. Mediation is about flexible and creative solutions that work for you! It is consensual, confidential and informal.  It is not rocket science to realise that when we make our own decisions, reach our own peace within a conflict, we are more likely to honour and uphold the outcome.
